
The Department of Justice announced today that they have filed suit against New York State, Gov. Kathy Hochul, AG Leticia James and DMV Commissioner Mark Schroeder. US Attorney General Pam Bondi stated that the lawsuit is based upon New York's sanctuary policies of limiting law enforcement agencies from working with immigration authorities and New York's "Green Light" law.
New York's "Green Light" law was enacted in 2019 and allows illegal aliens to obtain a driver's license (See our prior article at https://www.liattorney.com/scales-of-justice/new-york-state-makes-it-legal-for-illegals-to-drive). Further, it prohibits federal immigration agents from having access to the state's DMV records of these illegal aliens. It is argued that in addition to granting illegal aliens more rights than NYS grants to its legal taxpaying residents, these policies and laws contradict superseding federal laws, endanger federal agents and legal citizens, and have caused a spike in illegal alien crime. Proponents believe that sanctuary policies are necessary in order to make communities safer, increase trust between police and immigrants, and help create stronger communities.
This lawsuit follows one of a similar nature against Illinois, in what appears to be the new DOJ's systematic takedown of sanctuary states. Bondi has made it clear that she will not tolerate sanctuary states with policies and laws that disregard federal law, endanger federal agents and increase crime against legal citizens. One thing is certain, this is not Biden's DOJ.
