A Maryland jury has awarded the Martinez family $55 million dollars in a finding of medical malpractice against Johns Hopkins Hospital. This award is one of the highest in Maryland state history.
After a failed attempt to deliver her baby at home with a midwife, Martinez was rushed to the hospital by ambulance in need of an emergency c-section. Unfortunately, Martinez had to wait approximately 2 hours at the hospital before the surgery was actually performed. It was alleged that as a result of the 2 hour delay, the baby was oxygen deprived and born severely and permanently mentally and physically disabled. Due to state cap laws, the award was reduced to approximately $30 million dollars. The hospital plans to appeal.
